New Mexico cannabis legalization

New Mexico legalized cannabis through the legislature in 2021 after Gov. Michelle Lujan (D) called a special session to address the issue. The legalization law took effect on June 29, 2021, and retail licenses are expected sometime in early 2022. The state’s medical cannabis program, which is regulated by the New Mexico Health Department, is in full swing with dozens of dispensaries in operation around the state.

Cannabis possession rules

  • New Mexico adults aged 21+ are allowed to possess up to two ounces of cannabis flower.
  • Possession of cannabis concentrates is capped at 16 grams.
  • Adults can also grow up to six plants in the privacy of their own homes.
